According to its website, Girardi Keese is a New York-based law firm specializing in complex and high-stakes litigation, as well as restructuring, bankruptcy, and reorganization matters involving corporations, partnerships, limited liability companies, and estates.
Kamon is alleged to have enabled the fraud by issuing checks from the firm without proper authorization, then accepting the cash kickbacks from the contractors and other firms who did business with the firm. He is accused of collecting more than $16 million in cash from the kickbacks, prosecutors say.
The government alleges that the firm engaged in a scheme for several years to defraud owners of companies and other entities who received financing from the firm. In at least one instance, federal prosecutors say, a senior partner received $1.5 million in cash kickbacks after arranging for the firm to issue a check to a contractor for a $250,000 job.
Kamon, 50, of Weehawken, N.J., was one of the alleged original perpetrators of the fraud scheme, as well as the former head of the firm, who was an original defendant. Both were acquitted in a trial last year after a jury deadlocked on the question of Kamon's guilt.
The investigation into the side fraud was sparked by an examination of checks that involved multiple bank accounts, including two $100,000 checks written in August 2001 to Mark Dahnke, a subcontractor at Girardi Keese. Two days later, the law firm issued a check to Dahnke for $10,000.
Kamon isn't the only Girardi Keese official charged in connection with the case. Richard Gens, the firm's former CEO, pleaded guilty in February to tax fraud and agreed to cooperate in the investigation. In August, he admitted that he had embezzled more than $6 million from Girardi Keese.
Kamon, 59, a former top executive for powerhouse law firm Skadden, Arps, Meagher & Flom, is charged with securities fraud, bank fraud and tax fraud. The 59-year-old faces up to 50 years in prison if convicted. His lawyer, Richard Emery, has said Kamon is innocent and will plead not guilty. The charges stem from a Securities and Exchange Commission probe that began in 2000. Kamon has said he is cooperating with the SEC and the Manhattan District Attorney.
